Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you”) and Betasouls Inc. (“Betasouls,” “we,” “us”), a Delaware corporation, governing your access to and use of the platform at betasouls.ai and all associated services.

By creating an account, clicking “Sign in,” or otherwise accessing or using our platform, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

2. Eligibility

You must be at least 13 years old to use Betasouls. If you are under 18, you represent that you have your parent’s or legal guardian’s permission to use the platform. By using Betasouls, you represent that you meet these age requirements and have the legal capacity to enter into this agreement. Use of Betasouls is void where prohibited by applicable law.

3. Your Account

To access most features, you must create an account. You may sign up using Google Sign-In. You agree to:

• Provide accurate and complete information when creating your account
• Keep your account credentials secure and not share them with others
• Notify us immediately of any unauthorized access at info@betasouls.ai
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably suspect are involved in fraudulent activity.

4. Description of Services

Info Aggregation

We aggregate publicly available product review content from third-party review platforms and community forums and use AI-powered summarization to surface key product insights, ratings, and selling points. This feature helps users efficiently research products and share their own opinions within the Betasouls community. AI-generated summaries are produced automatically and may not be complete, current, or error-free. Users should independently verify information before making purchasing decisions.

Community Features

Users may post reviews, opinions, and comments. SoulPoints may be earned and spent through community participation as described in Section 5.

Betapoly

Betapoly is a virtual prediction/gaming platform where users may spend and earn SoulPoints by participating in prediction challenges. See Section 5 for important details.

We reserve the right to modify, suspend, or discontinue any feature or the platform as a whole at any time with reasonable notice.

5. SoulPoints & Betapoly

Nature of SoulPoints

SoulPoints are virtual credits with no monetary value. They cannot be exchanged for real currency, transferred for value outside the platform, or redeemed for cash or cash equivalents. SoulPoints are owned by Betasouls and licensed to you for use within the platform.

Earning & Spending

SoulPoints may be earned through platform participation (e.g., posting reviews, completing activities) and spent on Betapoly predictions or other in-platform features. We may adjust the earning and spending mechanics at any time.

Betapoly Predictions

Betapoly allows users to make predictions on designated topics using SoulPoints. Correct predictions earn additional SoulPoints per the rules displayed at the time of participation. Betapoly is purely for entertainment using virtual currency and does not constitute gambling under applicable law, as no real money is wagered or awarded. Notwithstanding the foregoing, if Betapoly is determined to constitute gambling or a regulated activity under the laws of any jurisdiction, access to the Betapoly feature is not available to users in that jurisdiction, and such users must not participate.

No Guarantee

We make no guarantee regarding the availability, accumulation, or value of SoulPoints. SoulPoints may be forfeited upon account termination or if we determine they were obtained through fraudulent means.

6. User Conduct

You agree not to use Betasouls to:

• Post false, misleading, defamatory, or fraudulent content
• Harass, threaten, or harm other users
• Spam, scrape, or use automated bots to interact with the platform without our written permission
• Circumvent, manipulate, or exploit the SoulPoints or Betapoly systems
• Upload malware, viruses, or any malicious code
• Infringe upon any third party’s intellectual property rights
• Violate any applicable local, national, or international law or regulation
• Impersonate any person or entity

We reserve the right to remove content and suspend or terminate accounts that violate these rules, at our sole discretion.

7. User Content

You retain ownership of any original content you post on Betasouls (“User Content”). By submitting User Content, you grant Betasouls a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, distribute, and adapt your User Content solely for the purpose of operating, promoting, and improving the Betasouls platform.

You represent and warrant that your User Content does not violate any third-party rights and complies with these Terms. You are solely responsible for the accuracy and legality of your User Content. We may remove User Content that violates these Terms or that we determine is harmful or inappropriate.

8. Intellectual Property

All content, features, and functionality of the Betasouls platform - including software, design, text, graphics, logos, and Betapoly game mechanics - are owned by Betasouls Inc. and protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the platform for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or create derivative works of our platform or content without our prior written consent.

9. Third-Party Content

Our info aggregation features may display content sourced from third-party websites, review platforms, and community forums. This content belongs to its respective owners. Betasouls does not endorse, guarantee the accuracy of, or take responsibility for any third-party content displayed on our platform. Links to external sites are provided for convenience only.

10. Disclaimers

We do not warrant that the platform will be uninterrupted, error-free, or secure; that any information or content is accurate or up-to-date; or that SoulPoints systems will function without error. Product summaries provided through our aggregation feature are for informational purposes only and do not constitute professional purchasing advice.

11. Limitation of Liability

You agree to indemnify, defend, and hold harmless Betasouls Inc. and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the platform; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

13. Termination

You may terminate your account at any time by contacting info@betasouls.ai. We may suspend or terminate your access immediately, without prior notice, if we determine that you have violated these Terms or engaged in conduct harmful to other users or the platform.

Upon termination, your license to use the platform ceases immediately. Sections 7, 8, 10, 11, 12, and 14 survive termination.

14. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to conflict of law principles.

Any dispute shall first be attempted to be resolved informally by contacting us at info@betasouls.ai. If unresolved within 30 days, it shall be submitted to binding arbitration administered in the State of Delaware under the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform at least 14 days before the new Terms take effect. Your continued use of Betasouls after the effective date constitutes your acceptance of the changes.
